Changes to right to work checks

There is a requirement for businesses to check their employees have the right to work in the UK. 

In the past, this had to be done by checking the person’s ID and any immigration paperwork in person.  During the Covid-19 pandemic, the Home Office introduced temporary adjustments which meant it was possible to undertake those checks remotely.

However, after 30 September 2022 these temporary adjustments will be ending, meaning right-to-work checks will need to be conducted in the following ways.

For non-UK citizens:

  • the checks must be done online using the Home Office online right to work check, currently in place for people working under the EU Settlement Scheme, Biometric Resident Permits, Biometric Resident Card, or Frontier Worker permit. 
    There is no charge from the Home Office for this service.

For UK and Irish citizens:

Checks will need to be completed either by:

  • meeting with the employee and viewing the original documents. This will need to be done by a member of your team in person on or before their first working day, where you will need to take a copy of the document, sign, date it, and store it securely. 

or

  • online using an Identification Service Provider (IDSP). The service will check the right-to-work documents online. Candidates will upload their documents and be verified digitally using an external provider, who will charge for the service.
